These Terms & Conditions govern your use of this website and any purchase you make from it. The website is operated by SHIVSREE CREATIONS under the brand Modura ("we", "us", "our").

By accessing this website or placing an order, you agree to these Terms. If you do not agree, please do not use the website.

1. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to purchase from us. By placing an order you confirm that you meet this requirement.

2. Products and descriptions

We describe our products as accurately as we can — fabric composition, fit, measurements and care instructions are stated on each product page.

Colour: product photographs are taken under studio lighting. Screen calibration varies between devices, so the shade you see may differ slightly from the garment. A minor colour variation is not a defect.

Measurements: garment measurements carry a normal manufacturing tolerance of approximately half an inch. Natural fibres may relax or shrink marginally after the first wash despite pre-treatment.

Availability: stock shown on the website reflects our inventory at that moment. Occasionally an item sells out between your adding it to cart and completing payment. Where this happens we will contact you and refund you in full.

3. Pricing and taxes

  • All prices are in Indian Rupees (INR) and are inclusive of GST unless stated otherwise.
  • A GST-compliant tax invoice is issued with every order.
  • Shipping charges and any COD handling fee, where applicable, are shown at checkout before payment.
  • We reserve the right to change prices at any time. The price applicable to your order is the price displayed at the time you complete checkout.
  • If a product is listed at a manifestly incorrect price due to a technical or human error, we may cancel the order and refund you in full. We will contact you before doing so.

4. Orders and acceptance

Your order is an offer to buy. A contract is formed only when we dispatch the goods, not when you receive an order confirmation email. We may decline or cancel an order where:

  • the item is unavailable;
  • we cannot verify a COD order or the delivery address;
  • we suspect fraud, misuse of a discount code, or reseller activity;
  • the delivery location is not serviceable;
  • there has been a pricing or listing error.

Where we cancel an order you have paid for, we refund you in full.

5. Payment

We accept UPI, credit and debit cards, net banking, wallets and Cash on Delivery where available. Payments are processed by third-party payment gateways. We do not store your card or UPI credentials. Where a payment is debited but the order does not confirm, the amount is normally auto-reversed by your bank within 5 to 7 business days; contact us if it isn't.

6. Shipping, returns and exchanges

Delivery is covered by our Shipping Policy. Returns, exchanges and refunds are covered by our Returns & Exchanges policy. Both form part of these Terms.

7. Discounts and promotions

  • Discount codes cannot be combined unless expressly stated.
  • Codes have no cash value and cannot be exchanged for cash.
  • We may withdraw or modify a promotion at any time before your order is placed.
  • We may cancel orders where a code has been obtained or used in breach of its terms.

8. Accounts

If you create an account, you are responsible for keeping your login credentials confidential and for all activity under your account. Tell us immediately if you suspect unauthorised access. We may suspend or terminate an account that is used fraudulently or in breach of these Terms.

9. Intellectual property

All content on this website — the Modura name and logo, product designs, prints, graphics, photographs, copy and page layouts — is owned by or licensed to us and protected under Indian and international intellectual property law.

You may not reproduce, distribute, or create derivative works from this content, or use our trade marks, without our prior written permission. You may view and print pages for your own personal, non-commercial use.

10. Acceptable use

You agree not to use this website to commit fraud, transmit malicious code, scrape or harvest data by automated means, interfere with the site's operation, resell our products without authorisation, or infringe anyone's rights.

11. Third-party links

This website may link to third-party sites. We do not control them and are not responsible for their content, products or privacy practices. Visiting them is at your own risk.

12. Limitation of liability

We are responsible for supplying goods that match their description and are of satisfactory quality, as required under the Consumer Protection Act, 2019. Nothing in these Terms limits your statutory rights as a consumer, or our liability for death or personal injury caused by our negligence, or for fraud.

Subject to that, and to the maximum extent permitted by law, our total liability arising out of or in connection with any order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, including loss of profit, opportunity or goodwill.

We are not liable for delays or failures caused by events outside our reasonable control, including natural disasters, strikes, civil unrest, pandemics, transport disruption, government restrictions, or failures of internet or payment infrastructure.

13. Privacy

Our handling of your personal data is described in our Privacy Policy, which forms part of these Terms.

14. Grievance redressal

In compliance with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Act, 2000, complaints may be addressed to our Grievance Officer:

We acknowledge complaints within 48 hours and aim to resolve them within 30 days.

15. Governing law and jurisdiction

These Terms are governed by the laws of India. The courts at Hosur, India have exclusive jurisdiction over any dispute arising out of or in connection with them, subject to your rights under the Consumer Protection Act, 2019 to approach a consumer forum where you reside.

16. Changes to these Terms

We may update these Terms from time to time. The version in force at the time you place an order is the version that applies to that order. Changes are posted on this page with a revised "Last updated" date.
